This Legal Notice regulates the use of the networking and geolocation mobile application service ‘WanderPad’ and the website available at https://wanderpad.app . For identification purposes, the person responsible for the service is:

WanderPad is a networking, community, and resource platform for workationers and digital nomads, managed by Miriam Ojembarrena as a self-employed professional.

Object and Scope of Application

This Legal Notice regulates the conditions for access, browsing, and use of the Service (web and app), as well as the responsibilities derived from the use of its contents. Accessing and using the Service grants the status of User and implies full and unreserved acceptance of all conditions included in this document, along with WanderPad’s Privacy Policy and Cookies Policy.

In the event of a contradiction between this Legal Notice and the Terms and Conditions, the latter shall prevail.

Legislation

The relationship between Miriam Ojembarrena Cerezo and the Users of the Service is governed by Spanish legislation. The parties expressly waive any other jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of ARABA (Spain) to resolve any controversy that may arise in the interpretation or execution of these contractual conditions.

Content and Use

The owner of the Service does not necessarily identify with the opinions expressed by its collaborators. The owner reserves the right to make, without prior notice, any modifications deemed appropriate to the Web/App, and may change, delete, or add both the content and services provided, as well as the way in which they are presented or located on its servers.

Intellectual and Industrial Property

All content, graphic elements, logos, designs, texts, software, databases, and other materials available in the Service are the property of Miriam Ojembarrena Cerezo or third parties who have authorized their use. The reproduction, distribution, public communication, transformation, or any other use of these materials is expressly prohibited without the prior written authorization of the owner.

The User agrees to respect all intellectual and industrial property rights associated with the Service and shall refrain from deleting or manipulating any rights notices or technical protection measures.

Conditions of Use

The User agrees to make appropriate and lawful use of the Service in accordance with applicable legislation and these conditions. In particular, the User shall refrain from:

  • Using the Service for purposes that are illicit, contrary to good faith, or against public order.

  • Introducing computer viruses, malware, or any system capable of causing damage to the owner’s systems or those of third parties.

  • Attempting to access restricted areas of the system or manipulating information contained in the Service.

  • Engaging in activities that interfere with or interrupt the functioning of the Service.

Access to the website or app does not, in any way, imply the start of a commercial relationship between the User and Miriam Ojembarrena Cerezo.

The contents and materials included in the Service are for informational and guidance purposes only. Miriam Ojembarrena Cerezo reserves the right to modify, update, or delete content, design, or services at any time without prior notice. Subscription Conditions and Payments

WanderPad offers free services and ‘Premium’ subscription models. Prices, features, and automatic renewal conditions will be clearly detailed before contracting. Payment will be managed through the Apple App Store and Google Play Store. The User may cancel the automatic renewal at any time through their account settings, maintaining access until the end of the current paid period.

Right of Withdrawal

In accordance with consumer regulations, the User may withdraw within 14 days, unless they have expressly consented to the start of the digital Service provision and acknowledged the loss of their right of withdrawal.

Use of Geolocation

WanderPad uses geolocation services to facilitate networking. The User acknowledges that location accuracy depends on external factors (GPS, network, device). Miriam Ojembarrena Cerezo is not responsible for technical inaccuracies or the use that other users make of the location voluntarily shared by the User.

Liability

The User accesses and uses the Service at their own risk. Miriam Ojembarrena Cerezo does not guarantee the continuous availability of the portal or app, nor is she responsible for damages or losses derived from interruptions, technical errors, or cyberattacks. Furthermore, she shall not be liable for damages resulting from improper use of the Service or the information it contains. WanderPad is not responsible for the contents, opinions, messages, images, or reviews published by users; each user is solely responsible for the content they post. However, WanderPad may remove content that infringes on the law, third-party rights, or Service rules.

Access for Minors

The Service is intended for individuals over the age of 16. WanderPad is not responsible for the access or use of the Service by minors who do not meet this requirement.

Protection of Personal Data

Use of Cookies
