4. Purpose of Processing
We process your data to manage your account, enable multimedia communication, facilitate local networking, and redeem “perks.” The legal basis is the execution of the contract and your consent (location and cookies). We use your personal data to:

Some service providers (Firebase, Google Cloud, Apple) may be located outside the European Economic Area. Such transfers are carried out under adequate protection mechanisms (Standard Contractual Clauses, privacy certifications).

We will keep your personal data as long as your account is active or necessary to provide the Service. You can request the deletion of your account at any time from the app Settings or by contacting us. After deletion, we will keep certain data in anonymized form or when a legal obligation exists during the periods established by applicable regulations.

TERMS AND CONDITIONS
This contract regulates the use of the WanderPad mobile application and web portal, managed by MIRIAM OJEMBARRENA CEREZO (Tax ID: 58006761W), with registered address at C/ Vitoria nº 8, Villanañe, Álava, Spain.
1. Acceptance
By creating an account or using the WanderPad app (“Service”), you accept these Terms and our Privacy Policy.
2. Who can use WanderPad
You must be at least 16 years old (or the minimum age required in your country) and have the legal capacity to accept these Terms. If you use SSO (Apple/Google), you accept their respective terms.
3. Your Account
You are responsible for:
The veracity of your data.
Maintaining the confidentiality of your credentials.
All activity carried out from your account.
We may request email/OTP verification and take measures if misuse is detected. Users may stop using the Service and request account deletion at any time via app settings or by contacting WanderPad. Deletion implies loss of access to the Service, without prejudice to legal data retention obligations.
4. Permitted Use
WanderPad is designed for discovering places, connecting with the community, and redeeming benefits (“Perks”). You may not:
Use the Service for illegal, defamatory, discriminatory, or harassing purposes.
Upload content that infringes third-party rights (copyright, trademark, image rights).
Manipulate reviews, ratings, or perks.
Attempt to access, extract, or “scrape” data automatically.
5. User Content
You retain ownership of your content (texts, photos, reviews). You grant WanderPad a non-exclusive, worldwide, royalty-free, and sublicensable license to host, reproduce, and display your content for the operation and promotion of the Service. We may moderate or remove content that breaches these Terms or applicable laws.
By allowing the exchange of text, images, videos, and audio, the user accepts:
Responsibility: You are solely responsible for the files and messages you share.
Prohibited Content: Discriminatory, defamatory, illegal, obscene, violent, or hate-inciting content is not tolerated.
Moderation: WanderPad uses AI and human review to filter inappropriate content.
Reporting and Blocking: WanderPad will act diligently, aiming to respond within 24 hours of receiving a report (content removal or user expulsion). Suspension may be temporary or permanent for serious breaches.
6. Geolocation and “WANDERPAD FRIENDLY SPACES”
WanderPad uses real-time location to show nearby spaces.
Requires explicit operating system permission.
WanderPad does not guarantee the permanent veracity of information provided by third parties (partner venues, Wi-Fi quality, etc.).
7. Locations, Perks, and Third Parties
Information on places and benefits may come from third parties. We do not guarantee availability, accuracy of hours, or that a perk is always active. Wi-Fi networks, prices, capacity, and conditions may vary.
8. Payments (if applicable)
If you add in-app purchases, subscriptions, or paid perks: you will see the price, taxes, and conditions before confirming. Unless stated otherwise, purchases are non-refundable once consumed. Manage subscriptions via the store (App Store/Google Play).
When subscribing to WanderPad Premium, you agree that payment will be charged to your account upon confirmation. The subscription will automatically renew at the same price and duration unless auto-renew is turned off at least 24 hours before the end of the current period.
9. Subscriptions and “Early Adopter” Promotion
Promotion: Users registered during the launch phase will enjoy 6 months of free subscription.
Payment: After the free period, WanderPad may offer premium plans. Notice will be given 30 days in advance. Payments are handled exclusively through the Apple App Store or Google Play Store.
10. Security and Community
We apply measures against spam, fraud, and abuse. We may suspend or cancel accounts for breach of these Terms or security risks.
11. Availability
We may modify, suspend, or interrupt Service functions (total or partial) for technical, legal, or business reasons.
12. Disclaimer and Limitation of Liability
WanderPad is provided “as is.” To the extent permitted by law, we assume no liability for indirect losses, loss of opportunity, or data. Our total aggregate liability shall not exceed the amount paid by you (if any) in the last 12 months.
13. Intellectual Property
WanderPad, its logo, design, and software are the property of Miriam Ojembarrena Cerezo. You do not acquire rights to trademarks or code.
14. Changes to Terms
We may update these Terms. We will notify you via the app or email. Continued use implies acceptance.
15. Governing Law and Jurisdiction
These Terms are governed by Spanish law. The parties submit to the Courts and Tribunals of Álava (Spain), except where mandatory consumer regulations apply.
